Is Amazon Facing a Game-Changing Products Liability Lawsuit?

Amazon provides one of the largest and most popular online retail platforms on the internet. The company presents an opportunity for third-party sellers to deliver products to Tennessee residents who place orders. Unfortunately, some products come with harmful defects, and Amazon might now find itself legally responsible for defective items sold on its platform.

A Lawsuit Over Dangerous Products

The U.S. Consumer Product Safety Commission, or CSPC, took action against Amazon for “dangerous and defective products” sold on the e-commerce site. Amazon has long sought to deflect blame and fault for such troubled products, suggesting that it is not responsible for what private sellers offer.

The CSPC noted that Amazon’s sellers have distributed many faulty products. The CSPC wants to hold Amazon accountable for not making quality control and consumer safety top priorities.

Amazon did take action after the filing of the lawsuit and removed the products mentioned in the legal action. However, the CSPC does not feel that the online giant is doing enough to protect consumers.

If victorious, the CSPC’s lawsuit could do more than motivate future action by Amazon: Other online retailers and marketplaces would need to take action to prevent liability suits. These companies may find themselves policing private sellers more closely.

Addressing Product Liability

Defective products could cause great harm to consumers who purchase items in good faith. Choking, fire and other hazards might lead to injuries that result in hospital bills, pain and suffering, and more.

If a third-party seller is a business entity, it could have liability insurance to cover claims. Absent insurance, an injured party may be able to file a personal injury suit in an attempt to recover damages.
